Qualified Occupant Sample Clauses
A Qualified Occupant clause defines who is permitted to reside in a leased property besides the primary tenant. Typically, this clause specifies that only individuals meeting certain criteria—such as immediate family members or those approved by the landlord—may live in the unit. By clearly outlining who qualifies as an occupant, the clause helps prevent unauthorized subletting or overcrowding, ensuring the landlord maintains control over who resides in the property and reducing potential risks associated with unapproved tenants.
Qualified Occupant. Any person who is not the Subject Property Owner, and who occupies the Subject Property as his or her Primary Residence in compliance with this Covenant.

The parties hereby agree that if within 60 days of the execution of this Agreement Tenant/Buyer is unable to find an occupant for the Premises that he or she designates as qualified, the Agreement may be cancelled without penalty to either party and all monies paid in furtherance of this Agreement shall be refunded to the payor.
