Public Works Services Sample Clauses

Public Works Services. This paragraph applies if the Services involve construction, erection, repair, maintenance, or improvement of any public works (excluding professional services). 1. Any progress payments are payments on accounts and shall not be construed as acceptance by the City or any part of the work. All such progress payments, except for the final payment, shall be subject to correction on subsequent invoices after the discovery of any error. Approval of an invoice shall not foreclose the right of the City to examine Contractor’s books and records of to determine the correctness and accuracy of any item. 2. At the time of delivery to Contractor of the final payment, Contractor shall execute and give to the City a final receipt for the same. The acceptance of final payment shall constitute a waiver of all claims by Contractor. 3. The City may withhold amounts from any payment as may be necessary to cover: (a) any liquidated damages; (b) claims for labor or materials furnished Contractor or any subcontractor or reasonable evidence indicating probable filing of such claims; (c) failure of the Contractor to make proper payment to subcontractors or suppliers; (d) evidence of damage to another contractor, utility, or private property; (e) uncorrected defective work or guarantees that have not been met; (f) reasonable evidence that the work will not be completed within the allowed time and that the unpaid balance would not be adequate to cover actual or liquidated damages for the anticipated delay; or (g) any other amounts that the City is authorized to withhold. If the reason for withholding is removed, the City will make payment of the withheld sums with the next regular progress payment unless another basis for withholding exists. Execution of this Agreement by Contractor shall constitute a waiver by Contractor to claim any right of payment of interest upon any funds retained or withheld by the City pursuant to this Agreement or C.R.S. § ▇▇-▇▇-▇▇▇.
Public Works Services a. The Township shall provide grounds keeping services to the MTMUA Administration Building. b. The Township shall be responsible for providing salt for the parking lot of MTMUA Administration Building before and/after snow/or ice storms. The Township will be responsible for plowing the Township and MTMUA parking lots. c. The Township shall be responsible for maintaining and repairing all MTMUA vehicles. The cost of the parts will be invoiced directly to the MTMUA and they will be responsible for payment directly to the vendor.
Public Works Services. The City of Biddeford will provide pre-and-post public works services, excluding any services expended for damage or repair to City facilities that are caused by the negligence of LAKERMESSE officials, its subcontractors, vendors, or patrons of the Festival; or for the failure of LAKERMESSE to exercise proper care and protection of city facilities and equipment. The Department of Public Works shall provide specific services that include, but are not limited to, the transporting, transferring or storage of equipment, assisting in field set-up, waste removal, and moving services. LAKERMESSE will be billed for the cost of repair or replacement of damages or repair to City facilities as provided herein.
Public Works Services. Upon receipt of written Notice to Proceed from Client, BVNA will provide Inspection services relative to Public Works Services as outlined below to verify conformance with approved plans, specifications and local ordinances provided by Client. Inspection services include, but are not limited to: making site observations, writing correction notices and field reports, attending meetings and answering inquiries in person or by telephone. Plan Review services include, but are not limited to: verification of plan compliance with adopted public works standards, attendance at pre-plan design meetings and follow up on design issues. BVNA will be available for pre-construction or field site meetings and will provide field staff for observation purposes as needed.
