If and to the extent that any provision of this Indenture limits, qualifies or conflicts with the duties imposed by under Sections 310 to 317, inclusive, through 317 of the Trust Indenture ActAct of 1939, as amended, such imposed duties shall control. If any provision of this Indenture modifies or excludes any provision of the Trust Indenture Act which may be so modified or excluded, the latter provision shall be deemed to apply to this Indenture as so modified or excluded, as the case may be.

If and to the extent that any provision of this Indenture limits, qualifies or conflicts with the duties imposed by Sections 310 pursuant to 317, inclusive, Section 318(c) of the Trust Indenture ActAct of 1939, such the imposed duties shall control.

If and to the extent that any provision of this Indenture limits, qualifies or conflicts with the duties imposed by operation of the following sentence, the imposed duties shall control. The provisions of Sections 310 to 317, inclusive, of the Trust Indenture ActAct of 1939 that impose duties on any Person (including provisions automatically deemed included in this Indenture unless this Indenture provides that such provisions are excluded) are a part of and govern this Indenture, such imposed duties shall controlwhether or not physically contained herein.
