On or before the Operational Date, Provider will deliver to Customer a written notice detailing the name and contact details for the Provider’s dedicated Customer Success Manager for all troubleshooting and maintenance concerns with respect to the System and the name and contact details of the Charger Technician (together with the Customer Success Manager, the “Provider Representatives”) who will be available to provide technical assistance with respect to the Chargers. From time to time during the Term, Provider may change the name and contact information for the Provider Representatives effective upon delivery of written notice to the Customer. In performing the Services, Provider’s employees and representatives shall be under the direction, control and supervision of Provider (and not Company), and Provider shall have the sole right to exercise all authority with respect to the employment (including termination of employment), assignment and compensation of such employees and representatives. Under no circumstances shall Company be deemed a joint employer or co-employer of any of Provider’s employees, if any, who are providing Services under this Agreement.

(1) The Provider may, from time to time, appoint a person or organisation to represent it in relation to this Agreement, including:
(a) as the Provider's representative in the National Annual Agreement Review;
(b) as the Provider's representative in relation to local commissioning proposals by the DHB as described in clause B.29;
(c) to provide advice or assistance to the Provider in relation to a Dispute as set out in clauses
