The 'Project Schedule and Progress Reports' clause establishes the requirement for the contractor or service provider to create and maintain a timeline for project activities and to provide regular updates on the project's status. Project Schedule and Progress Reports. A progress report and updated project schedule must be submitted with each monthly pay request indicating the percent of services completed to date. This report will serve as support for payment to Contractor and the basis for payment in the event project is suspended or abandoned.

No later than sixty (60) days after the Provisional Commencement Date, Contractor shall submit to Owner a detailed electronic construction schedule that indicates, in a manner consistent with the overall construction schedule set forth in Appendix C hereto on the date hereof, the proposed dates for completion of the individual features of the Services set forth in Appendix C hereto (as such construction schedule may be adjusted pursuant to Article 12 hereof, the "Project Schedule"), and shall keep and furnish to Owner updated schedules of the Services, and Monthly Progress Reports of actual progress of the Services by the end of each month. Contractor shall provide five (5) hard copies and one (1) electronic copy of such Monthly Progress Reports in a format to be mutually and reasonably agreed upon by Contractor and Owner. Contractor shall be responsible for ensuring that performance of the Services proceeds in general accordance with the Project Schedule (as updated from time to time) and for coordinating and incorporating the schedules of all Subcontractors into the aforementioned schedules and progress reports. In addition, as soon as it is practicable but in no event later than one hundred twenty (120) days after the Provisional Commencement Date, Contractor shall provide Owner with a critical path method schedule (the "CPM Schedule") for the Project including activity durations for each major component of the Services. The CPM Schedule shall be updated on a monthly basis as the Services progress and shall include delay and acceleration analyses where appropriate.

Without limiting Contractor’s responsibilities under Article 8, Contractor shall perform the Work in accordance with the Project Schedule with the objective of achieving the Target Contract Dates and the Required Contract Dates. The Project Schedule, the Target Contract Dates and the Required Contract Dates (including those dates on which Owner is to perform any obligation hereunder as contained in the Project Schedule) may only be modified by agreement of both Parties. Contractor shall report progress on the Work and hold progress meetings as specified in Appendix A, which reports and meetings will include matters and activities relating to any on-going or anticipated Recovery Plans.

Within thirty (30) days following the Commencement Date, Contractor shall prepare and submit to Client an electronic P3 file and hardcopy of the detailed baseline schedule, consistent with the Project Schedule Summary, covering dates for items and services to be furnished such that the Facility will achieve Provisional Acceptance, Substantial Completion and Project Completion by the applicable Guaranteed Completion Dates (the “Project Schedule”). Contractor shall keep and furnish to Client updated monthly schedules of the Work to be performed, including a critical path schedule, as specified in the Project Schedule, and Monthly Progress Reports. Such updated monthly schedules shall include a comparison against the baseline schedule. Contractor shall be responsible for ensuring that performance of the Work proceeds generally in accordance with the Project Schedule (as updated from time to time) and for coordinating the schedules of Subcontractors.
