Prohibited Resources Clause Samples

The Prohibited Resources clause defines specific materials, substances, or resources that are not allowed to be used, accessed, or incorporated within the scope of an agreement or project. Typically, this clause lists items such as hazardous chemicals, restricted software, or materials sourced from unethical suppliers, and may require parties to certify that none of these resources are utilized. Its core function is to ensure compliance with legal, ethical, or safety standards by clearly identifying and forbidding the use of certain resources, thereby reducing risk and promoting responsible conduct.
Prohibited Resources. Aggregators shall coordinate with SCE and the Verification Administrator to ensure that all participants in their portfolio are compliant with the Prohibited Resources policy described in Schedule CBP. Aggregators are responsible for: 1. Obtaining signed attestations from their customers and provide them to SCE in a machine-readable format, mutually agreed upon with SCE, from all existing customers by December 10, 2018; 2. Beginning in January 1, 2019, for any newly enrolled customers or customers making changes to their attestation, Aggregators must fill out Form 14-980, obtain the customer's signature, and submit to SCE; 3. Inform its customers that the customer will be required to comply with any data requests or site visits requested by the third-party Verification Administrator related to the audit of Prohibited Resources; 4. Communicating changes to customer attestations, at a minimum on a monthly basis, to SCE; 5. Removing customers from their portfolio who do not provide a valid attestation within 60 days of December 10, 2018 using Form 14-933; 6. Removing customers from their portfolio within 30 days of being notified if the customer has violated the Prohibited Resources requirements using Form 14-933; 7. Recording, updating, and de-rating their portfolio nominations by the sum of all customer’s DAV on a monthly basis; 8. Conducting outreach and notification of the Prohibited Resources policy to their customers, which includes developing metrics, targets and record keeping systems to assess the effectiveness of their customer outreach and notification efforts, as well as demonstrating compliance with the above to SCE upon request; and 9. Storing all participant attestation documentation. If an Aggregator does not remove noncompliant participants with an uncured Type I Violation or a Type II Violation, SCE will terminate this agreement.
Prohibited Resources. The “Agreement for Aggregators Participating in the BIP Interruptible Program” is contingent upon compliance with the prohibition and submission of an aggregator customer attestation. Aggregators shall ensure that Prohibited Resources are not used to reduce load during demand response events, unless the customer has provided a valid attestation supporting its eligibility for an adjustment to the incentives paid based on the nameplate capacity of the Prohibited Resource, and that they are enforcing the Prohibited Resources policy. Proportional cost burdens for the Verification Administrator and the implementation of the verification plan may be shared by the customers on this Schedule. Aggregators are responsible for:
Prohibited Resources. You must not use any distributed generation technology using diesel, natural gas, gasoline, propane, or liquefied petroleum gas (collectively, “Prohibited Resources”) to reduce load during any demand response activity or event. You acknowledge and assent that you do not have any Prohibited Resources on-site at your residence and will not use any Prohibited Resources in the event you introduce or bring Prohibited Resources on-site in the future. If you introduce or bring Prohibited Resources on-site at your residence, Leap reserves the right to disconnect your Leap account and access to any demand services provided by Leap or a demand response provider authorized in accordance with these Leap Authorization Terms. If you are a non-residential customer (either an individual or entity), you must complete and sign a customer attestation form.
