Common use of Program Action Plan Clause in Contracts

Program Action Plan. 1. The Borrower shall, through MFEPT and MESA: (a) implement the Program Action Plan agreed with the Bank, in a manner and substance satisfactory to the Bank; and (b) refrain from amending, revising, waiving, voiding, suspending or abrogating, any provision of the Program Action Plan, whether in whole or in part, without the prior written concurrence of the Bank. 2. In the event of any conflict between the provision of the Program Action Plan and those of this Agreement, the provision of this Agreement shall prevail.

Program Action Plan. 1. The Borrower shall, through MFEPT and MESA: (a) implement the Program Action Plan agreed with the Bank, in a manner and substance satisfactory to the Bank; and (b) refrain from amending, revising, waiving, voiding, suspending or abrogating, any provision of the Program Action Plan, whether in whole or in part, without the prior written concurrence of the Bank. 2. In the event of any conflict inconsistency between the provision of the Program Action Plan and those of this Agreement, the provision of this Agreement shall prevailgovern.

The Borrower shall, through MFEPT and MESAshall cause the Program Implementing Entity to: (a) implement the Program Action Plan agreed with the Bank, in a manner and substance satisfactory to the Bank; and (b) refrain from amending, revising, waiving, voiding, suspending or abrogating, any provision of the Program Action Plan, whether in whole or in part, without the prior written concurrence of the Bank. 2. In the event of any conflict inconsistency between the provision of the Program Action Plan and those of this Agreement and/or the Program Agreement, the provision of this Agreement the latter agreement(s) shall prevailgovern.

The Borrower shall, through MFEPT and MESA: : (a) implement cause the Program Action Plan agreed with the Bank to be carried out in accordance with the schedule set out in said Program Action Plan, in a manner satisfactory to the Bank; and (b) maintain policies and procedures adequate to enable it to monitor and evaluate, in a manner and substance satisfactory to the Bank; and, the implementation of the said Program Action Plan. The Borrower shall not materially and/or substantially amend, revisingrevise, waivingwaive, voiding, suspending abrogate or abrogating, suspend any provision of the Program Action Plan, whether in whole or in part, Plan without the prior written concurrence consent of the Bank. 2. In the event of any conflict between the provision of the Program Action Plan and those of this Agreement, the provision of this Agreement shall prevail.

In the event of (b) The Borrower shall not assign, amend, abrogate, or waive, or permit to be assigned, amended, abrogated, or waived, any conflict between the provision of the Program Action Plan provisions without the prior consent of the Bank and those of this Agreement, the provision of this Agreement such consent shall prevailnot be unreasonably withheld.
