Professional Ability Clause Samples
The 'Professional Ability' clause defines the expected level of skill, competence, and expertise that a party—typically a service provider or contractor—must possess and apply when performing their obligations under an agreement. This clause often requires that the party perform their duties in accordance with industry standards or the practices of a reasonably skilled professional in their field. For example, an architect or consultant would be expected to deliver services that meet the quality and diligence customary in their profession. Professional Ability. Contractor acknowledges, represents and warrants that Contractor and its employees are skilled and able to competently provide the services hereunder, and possess all professional licenses, certifications, and approvals necessary to engage in their occupations. City has relied upon the professional ability and training of Contractor as a material inducement to enter into this Contract. Contractor shall perform in accordance with generally accepted professional practices and standards of Contractor's profession. In the event that City, in its sole discretion, desires the removal of any person employed or retained by Contractor to perform services hereunder, such person shall be removed immediately upon receiving notice from City.
Professional Ability. City has relied upon the professional training and ability of CBF to perform the services hereunder as a material inducement to enter into this Agreement. CBF shall therefore provide properly skilled professional and technical personnel to perform all services under this Agreement. All work performed by CBF under this Agreement shall be in accordance with applicable legal requirements and meet the standard of quality ordinarily expected of competent professionals in CBF’s field of expertise.
