Common use of Product Return Clause in Contracts

Product Return. Bulk Motor Fuel Products that do not meet the Product quality requirements stated herein and are judged by Authorized Users to be unacceptable may be rejected. a. Contract with its vendor to pump the Product from the tank; b. Provide tank cleaning to bring the tank back to its prior condition; c. Replace the fuel at no additional cost to the Commonwealth; d. Reimburse Authorized User for the repairs to their vehicles, if the Authorized User’s vehicles are damaged by the contaminated Product; and, e. Provide a report, within 60 days of the incident to the Authorized User and OFMS on the resolution of the issue and the preventative measures to be put in place to reduce the possibility of future incident.
