PRODUCT MISUSE. You may not use the Licensed Software in an electronic communications network that is used wholly or mainly for the provision of publicly available electronic communications services (“Public Network”) in a manner that violates the rights to privacy or freedom of expression as outlined in the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights (collectively, “International Human Rights Standards”), of any individual user who directly accesses the Internet or otherwise transmits data through a Public Network, provided the foregoing shall not limit use of the Licensed Software in a Public Network to restrict, monitor, collect or process data accessed or transmitted by individual users based upon exceptions to the rights of privacy or freedom of expression that are recognized by International Human Rights Standards or authorized by local law or regulation.

PRODUCT MISUSE. If MSFB suspects that Product in an agency’s inventory or previously distributed by an agency has been misused, MSFB will develop an action plan to investigate the misuse and address donor concerns. If after reasonable investigation MSFB determines that the agency has not responded in a timely and effective manner to address all concerns, it shall contact the agency’s CEO and Board Chair to notify him/her of the possibility of disciplinary actions such as counseling, product hold, and/or termination of the Agency Partnership Agreement and MSFB’s assumption of negotiation and resolution responsibilities. MSFB shall be available to advise the agency, as necessary, regarding investigation and resolution of Product misuse incidents.
PRODUCT MISUSE. Should any equipment malfunction as a result of abnormal environmental factors (including without prejudice to the generality of the fore- going mains power transients or dropouts, electromagnetic interference, extremes of humidity, vibration, electro-static damage , tempera- ture or pressure or chemical corrosion then all costs incurred by the company in repairing such equipment and investigating the causes of the malfunction shall be payable to the company.
