Producers’ Commitment. Subject only to Producers’ ▇▇▇▇▇▇▇ Reservations, Producers exclusively dedicate and commit to the performance of this Agreement the ▇▇▇▇▇▇▇ Dedicated Properties, represent that, from and after the Effective Date, the ▇▇▇▇▇▇▇ Dedicated Properties are not otherwise subject to any other gas gathering agreement or other commitment or arrangement that would permit or require Producers’ Gas from the ▇▇▇▇▇▇▇ Dedicated Properties to be gathered on any other gas gathering system, and agree not to deliver any Gas produced from the ▇▇▇▇▇▇▇ Dedicated Properties and owned or controlled by Producers or their Affiliates to any other gas gatherer, gas purchaser, gas marketer, or other Person prior to the ▇▇▇▇▇▇▇ Delivery Points. Producers agree to cause any existing or future Affiliates of Producers to be bound by, and to execute and join as a party, this Agreement. The dedication and commitment made by Producers and their Affiliates under this Agreement is a covenant running with the land.
Producers’ Commitment. Subject to the terms and conditions of this Agreement, during the term of this Agreement, Producer covenants and commits to purchase all Freshwater required to conduct its oil and gas operations within the Production Area from Seller, to the extent such Freshwater is made readily available at the Delivery Points as requested by Producer.

Producers agree to cause any existing or future Affiliates of Producers to be bound by, and to execute and join as a party, this Agreement. Subject only to Producers’ PRP Reservations, Producers exclusively dedicate and commit to the performance of this Agreement Producers’ Remaining Properties, represent that Producers’ Remaining Properties are not otherwise subject to any other gas gathering agreement or other commitment or arrangement that would permit or require Producers’ Gas from Producers’ Remaining Properties to be gathered on any other gas gathering system, and agree not to deliver any Gas produced from Producers’ Remaining Properties and owned or controlled by Producers or their Affiliates to any other gas gatherer, gas purchaser, gas marketer, or other Person prior to the PRP Delivery Points. Producers agree to cause any existing or future Affiliates of Producers to be bound by, and to execute and join as a party, this Agreement. The dedication and commitment made by Producers and their Affiliates under this Agreement is a covenant running with the land.

Subject only to Producers’ Springridge Reservations, Producers exclusively dedicate and commit to the performance of this Agreement the Springridge Dedicated Properties, represent that the Springridge Dedicated Properties are not otherwise subject to any other gas gathering agreement or other commitment or arrangement that would permit or require Producers’ Gas from the Springridge Dedicated Properties to be gathered on any other gas gathering system, and agree not to deliver any Gas produced from the Springridge Dedicated Properties and owned or controlled by Producers or their Affiliates to any other gas gatherer, gas purchaser, gas marketer, or other Person prior to the Springridge Delivery Points. Producers agree to cause any existing or future Affiliates of Producers to be bound by, and to execute and join as a party, this Agreement. The dedication and commitment made by Producers and their Affiliates under this Agreement is a covenant running with the land.
Producers’ Commitment. Producer shall purchase Freshwater from Seller at the Delivery Points as requested from time to time by Producer and as such Freshwater is available for sale to Producer by Seller. Producer shall have no obligation to request a minimum amount of Freshwater from Seller, and Seller shall have no obligation to sell a minimum amount of Freshwater to Producer; provided, however, that during the first six Contract Years of this Agreement, to the extent Producer requires Flushwater at an existing CDP or Planned CDP that is connected pursuant to Section 3.3 located within the Production Area, Producer shall request and purchase on an ongoing basis such Flushwater from Seller at the applicable Delivery Points prior to utilizing any third party source for Flushwater and Seller shall use reasonable efforts to deliver such Flushwater to Producer pursuant to the terms of this Agreement.
Producers’ Commitment. Producer shall purchase Freshwater from Seller at the Delivery Points as requested from time to time by Producer and as such Freshwater is available for sale to Producer by Seller. Producer shall have no obligation to request a minimum amount of Freshwater from Seller, and Seller shall have no obligation to sell a minimum amount of Freshwater to Producer; provided, however, that during the first six Contract Years of this Agreement, to the extent Producer requires Flushwater at an existing CDP or Planned CDP that is connected pursuant to Section 3.3 located within the Production Area to utilize for operations in or related to the Agreed Formation, Producer shall request and purchase on an ongoing basis such Flushwater from Seller at the applicable Delivery Points prior to utilizing any third party source for Flushwater and Seller shall use reasonable efforts to deliver such Flushwater to Producer pursuant to the terms of this Agreement, and in each case subject to any Conflicting Dedication and the provisions of Section 2.2
