PROCUREMENT INSTRUCTIONS. As required by State Finance Law §162, an Authorized User that is subject to the requirements of State Finance Law §162 shall first purchase all Medical Supplies and Equipment from the appropriate Preferred Source(s), if available in the Authorized User’s Form, Function and Utility from a Preferred Source. When a need arises that cannot be satisfied through Preferred Sources, the Authorized User shall follow the following steps to determine the appropriate source. 1. Search the Primary Contractor’s Standardized List for the item(s). 2. If the required item(s) cannot be found on the Primary Contractor’s Standardized List, search the Primary Contractor’s Contract Price List for the item(s). 3. If the Primary Contractor is unable to meet an Authorized User’s Form, Function, and Utility requirements, then the Authorized User shall repeat steps 1 and 2 with the Secondary Contractor. 4. Should both Contractors be unable to meet an Authorized User’s Form, Function, and Utility requirements, Authorized Users must follow statutory requirements for determining the appropriate source.
