Common use of Processing Order Clause in Contracts

Processing Order. The balance of available funds in your Deposit Account must be sufficient at all times to cover your ACH Entries. You must pay us in immediately available funds for the amount of any rejected Entries and for the amount of any returned debit Entries, or any adjustment Entries accepted by us that we have previously credited to your Deposit Account. Such amounts will be immediately due and payable by you to us. Your obligation to pay us remains immediately due and payable whether or not the rejected, returned or adjustment Entry was processed in accordance with any requirement of the NACHA Rules applicable to any party other than us and notwithstanding whether we or you may have a claim against another ACH participant for breach of the NACHA rules or other applicable law. We are not required to send a separate notice of debit Entries that are returned unpaid. Please see your Deposit Account for the posting order of items clearing your Deposit Account. The processing order of these items is important because if there is not enough money in your Deposit Account to pay for the items in the order they are processed in accordance with the processing order, there may be an overdraft attempt on your Deposit Account which may result in non-sufficient fund fees or an increase in the amount of fees. By opening a Deposit Account pursuant to this Agreement, you are consenting to our authorizing and paying non-sufficient fund fees on your ATM and Card transactions.
