Processing Building. Building and Contents are subject to lease.
Processing Building. The permitted uses by Tenant of those portions of the Processing Building that are included as part of the Premises (as depicted on Exhibit C) are the Sorting Line Area, the Bale Storage Area, Bay 6 and the Office. These areas are limited to receiving Recyclables and processing the same; sorting and baling the Recyclables; storing, staging, inspecting, handling, and loading the Recyclables into containers or trucks; performing waste characterizations; and performing necessary incidental administrative activities (collectively, the “Permitted Processing Building Use”). Tenant shall perform the processing of Recyclables in the areas of the Premises located inside the Processing Building only. The Permitted Processing Building Use by Tenant shall also include the use and storage of forklifts and equipment reasonably necessary to perform and support the Permitted Processing Building Use. Tenant shall have exclusive use of approximately 64,300 square feet of space (including the Sorting Line Area, Bale Storage Area, Bay 6, and Office) within the Processing Building, as depicted in Exhibit C. Tenant shall ensure that none of its activities or materials exceed the limitations of the dimensions of the Premises as depicted on Exhibit C and as may be designated by the District on the floor or the walls of the Processing Building. Tenant acknowledges that the heating, ventilating, and air conditioning system (“HVAC System”) located in the pre-sort room is in a state of disrepair and is non-functional. Neither the District nor Tenant shall have an obligation to repair or maintain the HVAC System. Tenant shall have non-exclusive use of the RTA, pedestrian corridors, lunchroom, and restrooms within the Processing Building, as depicted in Exhibit C.
