Common use of Prerequisite for Unsatisfactory or Basic Final Evaluation Clause in Contracts

Prerequisite for Unsatisfactory or Basic Final Evaluation. An unsatisfactory or basic performance rating may not be included in the final evaluation (i.e., evaluation summary) of a classroom teacher unless the concern(s) has been previously presented to the teacher in writing on the appropriate form and suggestions for improvement indicated on the appropriate form. Additionally, teachers will not be rated as overall unsatisfactory on a comprehensive evaluation based on their instruction in a subject or grade level they have not taught in the past five (5) or more years, if moved to the subject or grade level involuntarily. A plan/program of improvement is only to be used if a teacher is placed on probation. References to a plan/program of improvement in any observation or evaluation documents may only be made if a teacher is on probation. However, said documents may be used by the evaluator to indicate any concerns and to make suggestions for improvement.
