Preferential Hiring. During the life of this Collective Agreement, should the P AM Tilbury or Windsor operations hire new employees, seniority employees indefinitely laid-off from the Chatham operation, consistent with their seniority within the Chatham bargaining unit, may elect to be hired as an employee at the Tilbury or Windsor facility assuming they are qualified for the positions available. He/She will not be required to serve a new probationary period, however, will be paid in accordance with the new hire wage and benefit structure of the Tilbury or Windsor location. Fringe benefits eligibility will be effective upon his/her date of hire. The Company will recognize years of service for vacation, and continuous service for early retirement pension provisions, and each pension plan will be calculated using the actual "credited'" pension service (if applicable) earned in each plan. In addition, the employee's attendance and discipline history related to his/her employment in the Chatham facility will remain active, consistent with the terms and conditions of the Tilbury or Windsor Collective Agreements. Should the employee be recalled back to the Chatham operation, and accept the recall, he/she will be restricted from exercising this right for the remainder of this Collective Agreement. Should an employee on lay-off request, in writing, to exercise his/her preferential hiring rights in Tilbury or Windsor, the Company will notify him/her of such opportunity.
