POWER INCREASE. If Lessee so requests, Lessor will file an amendment to its application for the Channels or a modification application with the FCC seeking authority to increase the output power of the Channels to a higher level requested by Lessee, provided that such higher level will not be reasonably anticipated to cause harmful electrical interference to any other radio transmission facility for which an application has previously ITFS LEASE AGT. (REV. 11/1/96) PAGE 9 [NAME OF ITFS LICENSEE] 10 been accepted by the FCC or authorization granted by the FCC, and which is entitled to protection from such interference under FCC rules. In the event that said authorization for power increase is obtained, Lessee, at its sole expense, shall provide and install appropriate amplifiers and related equipment in order to effect said power increase and such amplifiers and equipment shall thereupon become part of the Leased Equipment. Lessee shall arrange for and pay for all costs, including legal and engineering fees associated with said application and power increase.
