Position Upon Return from Leave Sample Clauses
Position Upon Return from Leave. Any employee returning from an approved leave of absence as covered by this article who has complied with all the conditions upon which the leave was approved shall return as follows:
Position Upon Return from Leave. 1. Employees returning to work from an FMLA leave will be reinstated to the same or equivalent position as they held before the leave in accordance with provisions of the Family and Medical Leave Act of 1993.
2. When an employee with more than one year of seniority who is on any leave of absence other than an FMLA leave returns to work within twelve (12) weeks of the time that the leave began, the employee may be reinstated to the same or substantially equivalent position they held before the leave, if available. If not placed in the same or substantially equivalent position they held before the leave, the Agency may restore the employee, if qualified, to a vacant position of similar salary to that which they left, but not necessarily the same position or in the same department.
3. Notwithstanding any other provisions of this Article XV, employees returning to work from a leave provided to an employee as a reasonable accommodation due to a “disability” under the Americans with Disabilities Act or other applicable law will be reinstated to the same or substantially equivalent position to that which they held before the leave if qualified unless to do so would create an “undue hardship” for the Agency within the meaning of the Americans with Disabilities Act or other applicable law.
Position Upon Return from Leave. Subject to the provisions of this collective agreement, a teacher resumes her assignment at the same workplace upon returning from her basic maternity leave if the return from leave occurs during the subsequent school year, except by mutual agreement.

2. When an employee with more than one year seniority who is on any leave of absence, other than an FMLA leave, returns to work within three (3) months of the time that the leave began, the employee will be reinstated to the same or substantially equivalent position he/she held before the leave. This Paragraph shall apply to Unpaid Family Emergency Leaves for CJE, but shall not extend the period of the leave beyond that which is provided for in Paragraph C.6.
3. If not placed in a position under Subparagraph 2 immediately above and the employee seeks to return to work within the time permitted for that leave, the Agency shall restore the employee, if qualified, to a vacant position of similar salary to that which he/she left, but not necessarily the same position or in the same department.
4. Position Upon Return from Leave. An employee returning from a leave of absence other than sick leave in excess of twenty (20) days is entitled to a position within the District covered by the employee's teaching credential, but not necessarily the same position held just prior to receiving the leave of absence. The provisions of this paragraph shall not apply to employees on sick leave. To the extent that the Family and Medical Leave Act (FMLA) applies to an employee returning from a leave of absence, the District shall comply with the provisions of the FMLA when placing a returning employee.
