Common use of Police Duties Clause in Contracts

Police Duties. Police duties shall include any duties that, if performed while on duty, would have been considered as part of a member’s employment. Furthermore, the City agrees that an injury or sickness shall be considered “in the performance of police duties” if such injury is received or such sickness is contracted at any time while the member is actually performing police work , even if said member may not actually be on his/her regular tour of duty. The City further agrees that once a member of the bargaining unit reports for work, he/she is actually “on duty” and shall be covered under this Article for any injuries received or sicknesses contracted until the time that his/her tour of duty is completed. Provided however, the parties to this Agreement hereby agree that where an injury to a member was caused under circumstances creating a legal liability in some person or entity, other than the City, to pay damages in respect thereof, then the City shall be subrogated to the rights of the member to recover the damages from said other person or entity.
