Persons to be treated as holders. Except as ordered by a court of competent jurisdiction or as required by law, the Trustee, the Agent, the Paying Agents and the Issuer (notwithstanding any notice to the contrary and whether or not it is overdue and notwithstanding any notation of ownership or writing thereon or notice of any previous loss or theft thereof) may (a) for the purpose of making payment thereon or on account thereof deem and treat the bearer of any Note, Coupon or Talon as the absolute owner thereof and of all rights thereunder free from all encumbrances, and shall not be required to obtain proof of such ownership or as to the identity of the bearer of any Note, Coupon or Talon, and (b) for all other purposes deem and treat:
