Common use of Persons Receiving Distributions Clause in Contracts

Persons Receiving Distributions. Each Distribution shall be made to the Persons shown on the Company’s books and records as Unitholders as of the date of such Distribution; provided, however, that any transferor and transferee of Units may mutually agree as to which of them should receive payment of any Distribution under Section 4.1. In the event that restrictions on transfer or change in beneficial ownership of Units set forth herein or in the Securityholders Agreement have been breached, the Company may withhold distributions in respect of the affected Units until such breach has been cured.
