PERSONNEL ASSIGNMENT. A. Contractor shall assign , Project Manager, and as the Project Superintendent for the Project. So long as the Project Manager and Project Superintendent remain in the employ of Contractor, such persons shall not be changed or substituted from the Project, or cease to be fully committed to the Project except as provided in this Section. In the event Contractor deems it necessary, Contractor shall replace the Project Manager/Superintendent for the Project with a replacement with like qualifications and experience, subject to the prior written consent of District, which consent shall not be unreasonably withheld. Any violation of the terms and provisions of this Section 12.A. shall entitle District to terminate this Construction Services Agreement for breach, pursuant to the provisions of Section 11, above.
B. Notwithstanding the foregoing provisions of Section 12.A., above, if the Project Manager/Superintendent proves not to be satisfactory to District, upon written notice from District to Contractor such person shall be promptly replaced by a person who is acceptable to District in accordance with the following procedures: Within five (5) business days after receipt of a notice from District requesting the replacement of the Project Manager/Superintendent or promptly following the discovery by Contractor that the Project Manager/Superintendent is leaving the employ of Contractor, as the case maybe, Contractor shall provide District with the name of an acceptable replacement/substitution (together with such person’s resume and other information regarding such person’s experience and qualifications). If the District and Contractor cannot agree as to the replacement/substitution, the District shall be entitled to terminate this Agreement for breach pursuant to the provisions of the General Conditions.
PERSONNEL ASSIGNMENT. Any of the Parties may assign its staff to another Party according to the terms and conditions provided in Annex B of this Arrangement.
PERSONNEL ASSIGNMENT. Seller reserves the right to assign, or reassign personnel at its sole discretion.
PERSONNEL ASSIGNMENT. Engineer agrees to utilize the key personnel as submitted to District in its Project Plan, including its Project Manager. The Project Manager will be the primary contact for District and should have a thorough knowledge of all aspects of the Project and its status. During the term of this Agreement, no replacement of the Project Manager or any of the key personnel of Engineer’s Project team or its sub-consultants may be made without the written approval of District, which approval will not be unreasonably withheld. Nothing in this Section 13 is intended to or may be construed to prevent Engineer from employing or hiring as many employees as Engineer deems necessary for the proper and efficient performance of its services. District may request a change in the assignment of the key personnel. Engineer shall change key personnel to the satisfaction of District within 30 days following written direction to change by District.
PERSONNEL ASSIGNMENT. Quad reserves the right to determine which personnel will be assigned to perform the Work, and to replace or reassign such personnel as necessary to comply with its obligations hereunder. Quad employees assigned to perform Services on Client’s behalf are not authorized to make additional agreements that modify or bind Quad to additional obligations beyond the scope of this Agreement.
PERSONNEL ASSIGNMENT. Convenxia agrees not to sub-contract any of the work under any Statement of Work without the prior written consent of Yak, except as permitted in a Statement of Work. Convenxia shall remain liable for any Services subcontracted as if the work had been performed by Yak’s own employees.
PERSONNEL ASSIGNMENT. 33.1. In September of 2015, Firefighters and Officers shall be eligible for one station/shift selection process in order to move to the Four Platoon.
33.1.1. Future station/shift selection shall be by mutual agreement by Labor and Management.
33.2. Probationary positions shall be assigned by the Battalion Chiefs (BC) approved by the Deputy Chief of Operations.
PERSONNEL ASSIGNMENT. A. Assignment of Personnel The Director will be responsible for the assignment of all certified personnel. In the event that changes in any assignments are proposed, each employee affected will be notified at least fifteen (15) calendar days prior to the proposed change and consulted about the nature and extent of the change. Exceptions to the fifteen-day notice may be made in emergency situations or in the case of unforeseen enrollment changes.
B. Assignment Criteria In order to assure that students are taught by employees working within their areas of certification, the Board will make every reasonable effort to hire employees to teach in areas for which they hold a teaching license issued by the state of Tennessee. Waivers and permits will be held to a minimum.
