Common use of Permit Compliance Clause in Contracts

Permit Compliance. Such Party fails to obtain and maintain in full force and effect any Permit necessary for such Party to perform its obligations under this Agreement and such failure continues for more than sixty (60) days after notice thereof is given by the Non-Defaulting Party to the Defaulting Party.

Such Party fails to obtain and maintain or cause to be obtained and maintained in full force and effect any Permit (other than the Regulatory Approval) necessary for such Party to perform its obligations under this Agreement (“Permit Failure”) and such failure Permit Failure continues for more than sixty thirty (6030) days after notice thereof is given by the Non-Defaulting Party to the Defaulting Party’s actual knowledge thereof; provided, however, that, if a Party has more than three (3) Permit Failures during the Term, then such Party shall no longer have the benefit of any cure period.
