Emergency Notice. Where a breach of the SPA by the Service Provider seriously threatens public health or safety, or the safety of the facilities, the Licensee may issue an emergency notice to the Service Provider and a copy thereof is given to the Regulatory Board without delay. The notice shall specify the breach, and the health or safety issues which led the Licensee to issue the notice. While an emer-gency notice is in place, the Service Provider shall comply fully with the directions of the Licensee, and shall ensure that its staff and sub-contractors also comply with the Licensee’s directions.

Emergency Notice. In case of disaster (such as a train derailment or System failure) or other emergency demanding immediate examination or repairs to the existing System or Facilities, notice shall be given by either party to the other in person or by telephone to the Emergency Response Center(s) designated on Exhibit H attached hereto or as otherwise designated in writing by each party to the other. Such initial verbal or telephonic notice, however, must be confirmed in writing within forty-eight (48) hours. Each party will cooperate with the other to permit restoration of each party's operations as promptly as feasible after such emergency.
Emergency Notice. Notwithstanding the above, if the medical director determines that either the giving of notice or the waiting period described above might be detrimental to you or others, then such notice and/or waiting period shall not be required before relocation to a hospital or other appropriate facility. Under such circumstances, we are expressly authorized to transfer you to such hospital or other facility, and we will promptly notify your representative and your attending physician. Upon transferring you to such hospital or other facility, we will immediately provide you with a notice of cancellation. This Agreement shall be cancelled sixty (60) days following notice, unless your condition improves and you are subsequently readmitted to the Community.

Emergency Notice. Should your continued residency pose an imminent threat of serious harm to you or other residents, and the Medi- cal Director determines that either the giving of notice or the waiting period described above might be detrimental to you or other residents, then such notice and/or waiting period shall not be required before relocation to a hospital or other appropriate facility. If there is one of you under this Agreement, we are expressly author- ized to transfer you to such hospital or other facility, and we will promptly notify your responsible party and your attending physician. After transfer- ring you to such hospital or other facility, we will provide you with a notice of cancellation if you will be unable to return to the Health Center or your Residence at StoneRidge. You will continue to pay the Monthly Fee until removal of your furniture and other property has occurred. If removal of your furniture and other property is not accomplished we may remove and store your furniture and other property at the expense and risk of you or your estate. This Agree- ment will cancel upon the removal of your furniture and other property. Your First Person Fee will amortize as set forth in Exhibit A and will stop amortizing on the date you vacate the Residence or the Health Center and remove all your furniture and other property. Your Entrance Payment will be repaid in accordance with Exhibit A. If there are two of you under this Agreement, and one of you is transferred to a hospital or other appropriate facility under the circum- stances described in this section, the other person may continue to occupy the Residence or the Health Center under the terms of this Agreement as the first person. We are not responsi- ble for any charges related to such transfer or relocation to a hospital or other appropriate facility.
