Common use of Permanent Disability Clause in Contracts

Permanent Disability. “Permanent Disability” shall mean Executive’s inability to perform Executive’s duties hereunder due to a physical or mental condition for (a) a period of ninety (90) consecutive days or (b) an aggregate of one hundred twenty (120) days in any twelve (12) month period.

Permanent Disability. “The term "Permanent Disability” " shall mean that Executive’s inability , at the time notice is given, has failed to perform Executive’s his duties hereunder under this Agreement for not less than 90 working days (whether or not consecutive) in any 365-day period of as the result of his incapacity due to a physical or mental condition for (a) a period of ninety (90) consecutive days or (b) an aggregate of one hundred twenty (120) days in any twelve (12) month periodillness.
