Common use of Perishable Goods Clause in Contracts

Perishable Goods. Perishable Goods which are not taken up immediately upon arrival at their destination or which are not sufficiently marked or otherwise identifiable may be disposed of without notice to the Client, and the payment or tender to the Client of the net proceeds of any disposition (after deduction of all charges incurred by the Company) shall be equivalent to delivery.
