Common use of Periods of Responsibility Clause in Contracts

Periods of Responsibility. Clinical faculty appointed on an academic- year basis shall, by default, have periods of responsibility consisting of fall and spring semesters and immediately adjacent weeks included in the campus academic-year calendar. However, to facilitate clinical placement of students, the Xxxx and a clinical faculty member may agree in writing that summer shall constitute for that faculty member a period of responsibility rather than either fall or spring semester, provided that the summer period is designed to be equal in duration to a semester. Such reassigned period of responsibility is permissible only if non-state funds suffice to support half of that person's annual salary for work done in summer. The agreement for a reassigned period of responsibility may be for a fixed period or may be open-ended. If that period is open-ended, the reassignment must be revocable by either the Xxxx or the faculty member with one year's written notice. A clinical faculty member’s initial appointment or subsequent reappointment may require summer rather than fall or spring as a primary period of responsibility; under those circumstances, a change in the period of responsibility is permissible only upon written agreement between the Xxxx and the faculty member. (If Massachusetts repeals laws prohibiting use of state funds for instruction outside fall and spring semesters, this section's requirements for use of non-state funds shall become moot.)
