Common use of Performance Qualifications Clause in Contracts

Performance Qualifications. a. The Department reserves the right to investigate or inspect at any time whether the product, qualifications, or facilities offered by Contractor meet the Contract requirements. Contractor shall at all times during the contract term remain responsive and responsible. In determining Contractor’s responsibility as a vendor, the Department shall consider all information or evidence which is gathered or comes to the attention of the Department which demonstrates the Contractor’s capability to fully satisfy the requirements of the solicitation and the contract.
