Common use of Performance of Covenants by Special Warrant Agent Clause in Contracts

Performance of Covenants by Special Warrant Agent. If the Corporation fails to perform any of its covenants contained in this Special Warrant Indenture, then the Corporation will notify the Special Warrant Agent and the Agent in writing of such failure and, upon receipt by the Special Warrant Agent of such notice, the Special Warrant Agent will notify the Special Warrantholders of such failure on the part of the Corporation and may itself perform any of the said covenants capable of being performed by it, but shall be under no obligation to perform said covenants or to notify the Special Warrantholders of such performance by it. All sums expended or disbursed by the Special Warrant Agent in so doing shall be reimbursed as provided in Section 3.13. No such performance, expenditure or disbursement by the Special Warrant Agent shall be deemed to relieve the Corporation of any default hereunder or of its continuing obligations under the covenants herein contained.

All sums expended or disbursed by the Special Warrant Agent in so doing shall be reimbursed as provided in Section 3.133.11. No such performance, expenditure or disbursement by the Special Warrant Agent shall be deemed to relieve the Corporation Company of any default hereunder or of its continuing obligations under the covenants herein contained.

Performance of Covenants by Special Warrant Agent. If Subject to subsection 8.2(g), if the Corporation fails shall fail to perform any of its their covenants contained in this Special Warrant Indenture, then Indenture and the Corporation will notify the Special Warrant Agent and the Agent in writing of have not rectified such failure and, upon receipt by within ten Business Days after receiving written notice from the Special Warrant Agent of such noticefailure, the Special Warrant Agent will may notify the Special Warrantholders of such failure on the part of the Corporation and may unless the Special Warrant Agent shall itself perform any of the said covenants capable of being performed by it, but shall be under no obligation to perform said covenants or to notify the Special Warrantholders of such performance by itWarrantholders. All reasonable sums expended or disbursed by the Special Warrant Agent in so doing shall be reimbursed repayable as provided in Section 3.134.3. No such performance, expenditure or disbursement by the Special Warrant Agent shall be deemed to relieve the Corporation of any default hereunder herein or of its their continuing obligations under the covenants herein contained.
