Common use of Payments in Dollars Clause in Contracts

Payments in Dollars. With respect to (i) any Loan (other than an Alternate Currency Loan), or (ii) any other payment to Agent and the Lenders that shall not be covered by subsection (b) above, all such payments (including prepayments) to Agent of any Loan or other payment, including but not limited to principal, interest, fees or any other amount owed by Borrower under this Agreement, shall be made in Dollars. All payments described in this subsection (c) shall be remitted to Agent, at the address of Agent for notices referred to in Section 10.4 hereof, for the account of the Lenders (or the Fronting Lender) not later than 5:00 P.M. (Eastern time) on the due date thereof in immediately available funds. Any such payments received by Agent after 3:00 P.M. (Eastern time) shall be deemed to have been made and received on the next Business Day.

Any such payments received by Agent after 3:00 P.M. 11:00 A.M. (Eastern time) shall be deemed to have been made and received on the next Business Day.
