Payment Processing Agent. Medivolve hereby appoints MassLabs as its limited patient payment processing agent in order for MassLabs to accept credit card information from patients and input such information into Medivolve's third party payment processing service. By providing the thirdparty payment processing account information to MassLabs, Medivolve represents and warrants to MassLabs, (i) that MassLabs is authorized to use the third party payment processing account on Medivolve's behalf as its agent, (ii) Medivolve is authorized to appoint MassLabs as its payment processing agent under Medivolve's contract with the third party payment processor and that contract is full force and effect, and (iii) all the information provided to MassLabs regarding its third party payment processing account is accurate and true. Medivolve must immediately notify MassLabs of any changes to Medivolve's third party payment processing account which could affect MassLabs's processing of any payments.
