Common use of Patent Term Restoration Clause in Contracts

Patent Term Restoration. The Parties hereto shall cooperate with each other in obtaining patent term restoration or its equivalent in the Territory where applicable to Patent Rights. In the event that elections with respect to obtaining such patent term restoration are to be made, Schering shall have the right to make the election and Licensor agrees to abide by such election.

Patent Term Restoration. The Parties parties hereto shall cooperate with each ----------------------- other in obtaining patent term restoration or its equivalent supplemental protection certificates or their equivalents in any country in the Territory where applicable to Patent Rights. In the event that elections with respect to obtaining such patent term restoration are to be made, each of Schering and Myriad shall have the right to make the election and Licensor non-selecting party agrees to abide by such election.

The Parties hereto shall cooperate with each other in obtaining patent term restoration or its equivalent in the Territory world where applicable to SCOLR Patent Rights and Joint Patent Rights. In the event that If elections with respect to obtaining such patent term restoration are to be made, Schering Wyeth shall have the right to make the such election and Licensor agrees to SCOLR shall abide by such election.

In the event that elections with respect to obtaining such patent term restoration are to be made, Schering shall have the right to make the election and Licensor Sepracor agrees to abide by such election.
