Common use of Participant Outcomes Clause in Contracts

Participant Outcomes. Contractor shall achieve at least the minimum quarterly performance outcomes specified in the Work Activity Schedule, as such outcomes are defined by applicable Federal, State, WDB, County and WDB rules and regulations. If at the end of any time Contractor's actual Performance Outcome in any category is more than ten percent (10%) below that specified in the Work Activity Schedule ("Deficient Performance"), within fifteen (15) days after WDB determines and notifies Contractor that such a deficiency exists, Contractor shall submit to WDB a written plan for corrective action. If Contractor's actual Performance Outcomes reflect Deficient Performance in three or more categories, or if Deficient Performance in any category continues to exist for more than six (6) months from a notification of deficient performance, or if Contractor fails to timely submit a corrective action plan upon WDB's request, WDB may implement such corrective actions as it deems appropriate in its sole and absolute discretion, including without limitation reducing the "Contract Amount" and “Participant Payments Amount” as defined herein, immediately suspending this Contract pending appropriate action by Contractor, and/or terminating this Contract for "cause" as defined herein.
