Common use of Partial Taking Clause in Contracts

Partial Taking. Upon a Taking of only a part of the Real Property, the Building or the Premises then, except as hereinafter provided in this Article 12, this Lease shall continue in full force and effect, provided that from and after the date of the vesting of title, Fixed Rent and Tenant’s Proportionate Share shall be modified to reflect the reduction of the Premises and/or the Building as a result of such Taking.

Partial Taking. Upon a Taking of If only a part of the Real Property, the Building or the Premises shall be subject to a Taking then, except as hereinafter provided in this Article Paragraph 12, this Lease and the Term shall continue in full force and effect, provided that from and after the date of the vesting of title, Fixed the Rent and Tenant’s 's Proportionate Share shall be modified to reflect the reduction of the Premises and/or the Building as a result of such Taking.

Partial Taking. Upon a Taking of only a part of the Real Property, the Building or the Premises then, except as hereinafter provided in this Article 12, this Amended and Restated Lease shall continue in full force and effect, provided that from and after the date of the vesting of title, Fixed Rent and Tenant’s Proportionate Share shall be modified to reflect the reduction of the Premises and/or the Building as a result of such Taking.

Partial Taking. Upon a Taking of only a part of the Real Property, the Building or the Premises then, except as hereinafter provided in this Article 12, this Lease shall continue in full force and effect, provided that from and after the date that is the earlier of Tenant's deprivation of use or the date of the vesting of title, Fixed Rent and Tenant’s 's Proportionate Share shall be modified to reflect the reduction of the Premises and/or the Building as a result of such Taking.

Partial Taking. Upon a Taking of only a part of the Real Property, the Building Building, or the Premises Premises, then, except as hereinafter provided in this Article 12, this Lease shall continue in full force and effect, provided that from and after the date of the vesting of title, Fixed Rent and Tenant’s Proportionate Share shall be modified to reflect the reduction of the Premises and/or the Building as a result of such Taking.

Partial Taking. Upon a Taking of If only a part of the Real Property, the Building Building, or the Premises is the subject of a Taking then, except as hereinafter provided in this Article 12, this Lease shall continue remain in full force and effect, provided that from and after the date of the vesting of title, Fixed Rent and Tenant’s Proportionate Share shall be modified to reflect the reduction of the Premises and/or the Building as a result of such Taking.

Partial Taking. Upon a Taking of only a part of the Real Property, the Building or the Premises then, except as hereinafter provided in this Article 12, this Lease shall continue in full force and effect, provided that from and after the earlier of (i) the date possession is taken or (ii) the date of the vesting of title, Fixed Rent and Tenant’s Proportionate Share shall be modified to reflect the reduction of the Premises and/or the Building as a result of such Taking.

Upon a Taking of only a part (i.e., less than substantially all) of the Real PropertyProject, the Building or the Premises then, except as hereinafter provided in this Article 12Article, this Lease shall continue in full force and effect, provided that from and after the date of the vesting of title, Fixed Rent and Tenant’s Proportionate Share shall be modified to reflect the reduction of the Premises and/or the Building as a result of such Taking.

Partial Taking. Upon a Taking of only a part of the Real Property, the Building or the Premises then, except as hereinafter provided in this Article 12, this Lease shall continue in full force and effect, provided that from and after the date of the vesting of title, Fixed Rent Rent, Tenant's Tax Payment and Tenant’s Proportionate Share 's Operating Payment shall be modified to reflect the reduction of the Premises and/or the Building as a result of such Taking.

Partial Taking. Upon a Taking of only a part of the Real Property, the Building or the Premises then, except as hereinafter provided in this Article 12, this Lease shall continue in full force and effect, provided that from and after the date of the vesting of title, Fixed Rent and Tenant’s Proportionate Share shall be modified to reflect the reduction of the Premises and/or the Building and/or Tenant’s loss of any parking rights as a result of such Taking.
