Common use of Ownership and Injunctive Relief Clause in Contracts

Ownership and Injunctive Relief. All Intellectual Property Rights owned or controlled by Supplier shall remain the exclusive property of Supplier and nothing herein shall be construed as a sale, lease, loan, or transfer of any of such Intellectual Property Rights. Purchaser shall derive no rights, title or interest therein except as expressly set forth in this Agreement. Any technical information concerning the Supply Items that Purchaser acquires or develops in connection with the ownership or operation of the Turbines shall be the property of Supplier. Further, Purchaser acknowledges that a breach of the confidentiality provisions in this Agreement may cause Supplier irreparable harm and damage that may not be recoverable at law and that Purchaser shall be entitled to obtain injunctive relief in addition to any other rights or remedies Purchaser may have.
