Common use of Owner Election of Warranty Clause in Contracts

Owner Election of Warranty. With respect to services or materials, equipment, software or other items furnished by Vendor under this Agreement, to the extent and for the period a warranty is in effect for the same services or materials, equipment, software or other items under the CGSA, Owner may elect to make a warranty claim under this Agreement or the CGSA, but may not make a warranty claim under both such agreements for the same services or materials, equipment, software or other items. Nothing in this Agreement shall be construed to extend any warranties or obligations provided under the CGSA.
