Outstanding Specified Transactions. Upon the effectiveness of the Agreement, unless otherwise agreed to in writing by the parties to this Agreement with respect to specific Specified Transactions, all Specified Transactions then outstanding shall be subject to, governed by and construed in accordance with this Agreement. Each confirmation governing any Specific Transaction entered into prior to the date hereof shall constitute a supplement to, and form a part of, this Agreement, and will be read and construed as one with this Agreement.
