Common use of Outdoor Work Clause in Contracts

Outdoor Work. (a) Employees covered by this Agreement shall not be required to perform outdoor non-emergency work when the outside temperature, including wind chill index, is below thirty-two degrees Fahrenheit (32° F), or when the outside temperature, including heat index, is above ninety-five degrees Fahrenheit (95° F). (b) Employees covered by this Agreement shall not be required to perform outdoor training exercises during any period of lightning or thunderstorms at the training site. (c) The Fire Chief may suspend the provisions of this Section 6.2 for weather-related training or operations, such as ice rescue work, or during periods where the outdoor temperature remains unusually high or unusually low for an extended period of time, or the Fire Chief determines that outdoor non-emergency work must be performed in order to maintain the readiness of the Department or for other extenuating circumstances.
