Operator Compliance Clause Samples

The Operator Compliance clause requires the operator of a service, facility, or system to adhere to all relevant laws, regulations, and contractual obligations. In practice, this means the operator must maintain up-to-date knowledge of applicable legal requirements and implement procedures to ensure ongoing compliance, such as regular audits or staff training. This clause is essential for minimizing legal and regulatory risks, ensuring that the operator's activities remain lawful and aligned with industry standards.
Operator Compliance. The Operator agrees that in order to facilitate such implementation and compliance the Operator will, without limiting the Operator’s obligations under clause 13.6: (a) ensure that any Trains operated by the Operator comply with the Licence Conditions; (b) not operate any Trains on the Network until an Environment Protection Authority (“EPA”) approval has been obtained; and (c) comply with the terms of any applicable EPA approval.
Operator Compliance. The Hirer must ensure that any operator supplied by the Owner operates the Equipment in accordance with the OEM User Manual. Such operators are considered the Hirer's agents, and the Hirer assumes liability for any claims arising from their operation.
