Operational Covenants. The Licensee must, when exercising the licence: (a) be present at the licensed area at least 30 minutes before the commencement of the market trading hours; (b) trade continuously from a stall at the licensed premises during the market trading hours; (c) confine the trading activities within the licensed area and not obstruct public traffic areas or access ways; (d) permit without interference any officer of Council or department or agency of the Northern Territory Government to inspect the licensed area and the stall erected thereon to confirm compliance with this Agreement and legislative requirements; (e) not erect, install or suspend any advertising signage or other material in, on or about the licensed area without the prior approval of the permit holder; (f) not permit any person other than the Licensee or the Licensee’s employees to trade from a stall at the licensed area; (g) not permit animals of any kind unless an assistance animal complying with Section 9, Disability Discrimination Act 1992 to be on or at the licensed area where a food business is conducted; (h) when at the licensed area, not consume or offer to any other person (by sale or otherwise) alcohol in any form; (i) when at the licensed area, not hold or trade any: (i) X rated, pornographic or offensive goods or material (as determined by an authorised officer of Council or the permit holder in his or her unfettered discretion); (ii) counterfeit or other goods or materials where the sale of such items would breach the intellectual property of a third party; (iii) toy or cap guns; (iv) real or replica weapons; (v) dangerous or illegal substances; (vi) fireworks; (vii) good or materials not complying with relevant or applicable Australian Standards; or (viii) animals of any kind unless an assistance animal complying with Section 9, Disability Discrimination Act 1992; (j) not dispose of oils, fats or waste water in the garden beds or drains in and about Council land; (k) remove from the licensed area and dispose of all packaging materials, garbage and litter resulting from the Licensee’s trading activities at the stall and in so doing not use the rubbish bins provided by Council on Council land for the use of members of the public; and (l) at the close of the market trading hours, dismantle and remove at the Licensee’s own cost and expense the stall and all pictures objects signs notices and advertisements erected fixed placed or displayed by or on behalf of the Licensee on in or about the licensed area and shall make good any damage or disfigurement caused by reason of such dismantlement and removal and generally reinstate the licensed area to a good state of repair and condition.

Tenant agrees: (a) be present at to use, maintain and occupy the licensed area at least 30 minutes before the commencement of the market trading hours;
Leased Premises in a careful, safe and proper manner; (b) trade continuously from a stall at without the licensed premises during prior written consent of Landlord, not to place or maintain any merchandise or other articles in any vestibule or entry to the market trading hours;
Leased Premises, on the sidewalks or parking lot in the front, rear or sides of the building or adjacent thereto or elsewhere on the exterior thereof; (c) confine to maintain the trading activities within the licensed area Leased Premises in a clean, orderly and not obstruct public traffic areas or access ways;
sanitary condition, free of insects, rodents, vermin and other pests; (d) not to use, nor permit without interference nor suffer the use of, any officer of Council apparatus or department instruments for musical or agency other sound or video reproductions or transmission other than "background music," or any business or mechanical machines in such manner that would result in the sounds emanating therefrom or caused thereby being audible beyond the interior of the Northern Territory Government to inspect the licensed area and the stall erected thereon to confirm compliance with this Agreement and legislative requirements;
Leased Premises; (e) not erectto receive or ship articles, install fixtures, or suspend merchandise of any advertising signage or kind other material in, on or about the licensed area without the prior approval than from that portion of the permit holder;
Leased Premises designated on Exhibit A for such purposes; (f) not permit any person other than to store goods, wares or merchandise on the Licensee Leased Premises except for items which Tenant intends to use or offer for sale in the Licensee’s employees to trade from a stall at the licensed area;
regular course of its business; (g) not permit animals of any kind unless an assistance animal complying with Section 9, Disability Discrimination Act 1992 to be on or at the licensed area where a food business is conducted;
intentionally omitted; (h) when at to keep all mechanical apparatus reasonably free of vibration and noise which may be transmitted beyond the licensed area, not consume or offer to any other person (by sale or otherwise) alcohol in any form;
Leased Premises; (i) when at to properly vent and control any odors and not cause or permit objectionable odors to emanate or be dispelled from the licensed area, not hold or trade any:
(i) X rated, pornographic or offensive goods or material (as determined by an authorised officer of Council or the permit holder in his or her unfettered discretion);
(ii) counterfeit or other goods or materials where the sale of such items would breach the intellectual property of a third party;
(iii) toy or cap guns;
(iv) real or replica weapons;
(v) dangerous or illegal substances;
(vi) fireworks;
(vii) good or materials not complying with relevant or applicable Australian StandardsLeased Premises; or
(viii) animals of any kind unless an assistance animal complying with Section 9, Disability Discrimination Act 1992;
(j) not dispose of oilsto obstruct any driveway, fats corridor, footwalks or waste water in the garden beds parking area, or drains in and about Council land;
any other common area; (k) remove from not to conduct or permit to be conducted any auction, fictitious fire sale, going-out-of-business sale or bankruptcy sale, or other similar type sale in or connected with the licensed area and dispose of all packaging materials, garbage and litter resulting from the Licensee’s trading activities at the stall and in so doing not use the rubbish bins provided by Council on Council land for the use of members of the publicLeased Premises; and
(l) at not to place a load upon any floor which exceeds the close floor load which the floor was designed to carry; (m) not to use the Leased Premises for any unlawful or illegal business, use or purpose, or for any business, use or purpose which is immoral or disreputable, or which is hazardous, or in such manner as to constitute a nuisance of any kind (public or private), or for any purpose or in any way in violation of the market trading hourscertificates of occupancy (or other similar approvals of applicable governmental authorities); (n) to use the parking areas solely for the purpose of parking passenger cars, dismantle small vans, and remove at small trucks; (o) not to use the Licenseeparking areas or any common areas in any way or in any manner reasonably objectionable to Landlord, including but not limited to rallies, congregating, loitering, advertising, soliciting or marketing; and (p) not to park more vehicles than permitted under Landlord's advertised parking ratio. Tenant shall not install, or permit to be installed, any rooftop equipment without the prior written approval of Landlord, which approval may be withheld in Landlord’s own cost and expense the stall sole discretion. Any and all pictures objects signs notices and advertisements erected fixed placed or displayed rooftop equipment permitted by or on behalf of the Licensee on in or about the licensed area and Landlord pursuant to such prior written approval shall make good any damage or disfigurement caused by reason of such dismantlement and removal and generally reinstate the licensed area be subject to a good state of repair separate license agreement between Landlord and conditionTenant and Landlord’s then applicable rooftop annual rental rate.

(l) at the close of the market trading hours, dismantle and remove at the Licensee’s own cost and expense the stall and all pictures objects signs notices and advertisements erected fixed placed or displayed by or on behalf of the Licensee on in or about the licensed area and shall make good any damage or disfigurement caused by reason of such dismantlement and removal and generally reinstate the licensed area to a good state of repair and condition.
