Operating Procedure. On each and every occasion that Operators are determined, by the above definition, to be a sleeper, the following options will apply:
Operating Procedure. All probationary Bargaining Unit members will be evaluated every year. All permanent Bargaining Unit members, with the exception of Head Start, will be evaluated every other year.
Operating Procedure. 5.1 Balancing Provider shall conform to the terms of Transporter's GT&C and Rate Schedule MBA. 6.1 Balancing Provider shall pay Transporter, each month for which the MBA service is provided, for services rendered pursuant to this Agreement in accordance with Transporter's Rate Schedule MBA, or superseding rate schedule(s), on file with and subject to the jurisdiction of FERC. 6.2 Unless otherwise mutually agreed to, Balancing Provider shall pay Transporter for services hereunder the maximum applicable rates and charges, as established under Rate Schedule MBA and set forth on the Statement of Rates and Charges in Transporter's effective FERC Gas Tariff, including any applicable surcharges. 6.3 Transporter shall have the unilateral right from time to time to propose and file with the Commission such changes in the rates and charges applicable to Management of Balancing Agreement service pursuant to this Agreement, the rate schedule(s) under which this service is hereunder provided, or any provisions of Transporter's GT&C applicable to such services. Balancing Provider shall have the right to protest any such changes proposed by Transporter and to exercise any other rights that Balancing Provider may have with respect thereto.

Operating Procedure. The parties agree that the Operating Procedure as amended by this Agreement governs the relationship of the parties hereto and applies to all operations conducted in respect of the exploration, development and maintenance of the Joint Lands for the production of petroleum substances.

Operating Procedure. 7.1 Upon each occurrence of earning by Farmee in a 6 section block of Farmout Lands (and as between Farmor and Farmee), such Farmout Lands and the related Title Documents (to the extend of such lands) will become subject to the Operating Procedure with Farmee being the initial Operator thereunder. Subject to Section 7.2, the Operating Procedure will govern all future joint operations of the Parties upon or with respect to such earned Farmout Lands and Title Documents. 7.2 Upon each occurrence of earning by Farmee in Farmout Lands governed by an Existing JOA, Farmor and Farmee shall take all necessary steps, using the Assignment Procedure, to have Farmee made a party to the Existing JOA for a 40% participating interest in respect of the earned Farmout Lands.
Operating Procedure. 5.1 Shipper shall conform to the operating procedures set forth in Transporter's GT&C. 5.2 Nothing in Section 5.1 shall compel Transporter to park or loan, as applicable, Gas pursuant to Shipper's request on any given Day. Transporter shall have the right to interrupt or curtail the advancement and return of Gas for the account of Shipper pursuant to Transporter's Toll Schedule PALS-1.
