On Settlement. If the Buyer has provided a Bank Guarantee instead of paying the Deposit (or any part thereof) the Buyer must pay the Deposit (or any outstanding part thereof) to the Seller and in exchange the Deposit Holder will return the Bank Guarantee to the Buyer.
On Settlement. (a) the Buyer must, pay the Balance Purchase Price, adjusted as provided in this Contract, by Bank Cheque/s (as directed by the Seller or its Solicitors in writing); and
(b) the Seller must deliver (or cause to be delivered) to the Buyer (or as directed by the Buyer) Transfer Documents free from Encumbrances, unless detailed in Item 21, executed by the Seller in a form capable of immediate registration (save for stamping) in accordance with the Land Title Act 1994.
On Settlement. (a) On or before the settlement date under the Purchase Agreement:
(i) you agree to pay (or arrange for the payment of) your Balance Contribution to the Solicitor; and
(ii) subject to the Solicitor complying with our Solicitor Instructions, we agree to pay our Balance Contribution to the Solicitor.
(b) On or before the settlement date you must sign the Shared Ownership Agreement that we give to the Solicitor. We will ask the Solicitor to explain the Shared Ownership Agreement to you before you sign it.
(c) As you are responsible for payment of all Property Expenses under the Shared Ownership Agreement, you agree that any Property Expenses apportioned on the Vendor’s settlement statement will be paid by you.
(d) You agree to provide us with evidence that you have insured the Property in accordance with the Shared Ownership Agreement on or before the settlement date under the Purchase Agreement.
(e) We agree that you are entitled to receive the keys to the Property from the Vendor following settlement.
On Settlement the Buyer will pay the Deposit to the Seller and the Deposit Holder will return the Deposit Bond or Bank Guarantee (as applicable) to the Buyer.
On Settlement. INSURANCE: The property will remain at the risk of the Vendor until date of settlement or possession.
On Settlement. (i) title to the Chattels passes to you, and
(ii) we assign to you the benefit of any manufacturer’s or builder’s warranties in relation to the Property to the extent they are assignable.
