Common use of On-Line Systems Clause in Contracts

On-Line Systems. If an Authorized Person elects to transmit Written Instructions through an on-line communication system offered by Custodian, the use thereof shall be subject to any terms and conditions contained in a separate written agreement. If Client or an Authorized Person elects, with Custodian’s prior consent, to transmit Written Instructions through an on-line communications service owned or operated by a third party, Client agrees that Custodian shall not be responsible or liable for the reliability or availability of any such service.
