Common use of On-Line Inquiry and Modification of Records Clause in Contracts

On-Line Inquiry and Modification of Records. In connection with the Trust's use of the Electronic Services, BNYM may, at the Trust's request, permit the Trust to enter data directly into a BNYM database for the purpose of modifying certain information maintained by BNYM's systems, including, but not limited to, change of address information. To the extent that the Trust is granted such access, the Trust agrees to indemnify and hold BNYM harmless from all loss, liability, cost, damage and expense (including attorney's fees and expenses) to which BNYM may be subjected or which may be incurred in connection with any claim which may arise out of or as a result of changes to BNYM database records initiated by the Trust.
