Common use of Occurrence Clause in Contracts

Occurrence. If and to the extent that a Relief Event adversely affects the ability of the Contractor to perform any of its obligations under this Contract, then the Contractor shall be entitled to apply for relief from any rights of the Authority arising under clause 34.3 (Termination by the Authority for Contractor Default) and its obligations under this Contract.

Occurrence. 10.2 If and to the extent that a Relief Event adversely and materially affects the ability of the Contractor to perform any of its obligations under this Contract, Contract then the Contractor shall be entitled to apply for relief from any rights of the Authority arising under clause 34.3 (Termination by the Authority for Contractor Default) and its obligations under this Contract.
