Common use of Occupancy Status Clause in Contracts

Occupancy Status. At the time the Property was listed for sale, Seller believed that the Property was , but Seller has not made, nor does Seller make now, any representations or warranties as to whether the Property is occupied as of the Effective Date or will be occupied on the Closing Date. Buyer waives any right to terminate this Agreement based on the actual occupancy status of the Property at any time and agrees to accept the Property subject to any occupancy which exists as of the Closing Date.
