Common use of Occupancy Permit Clause in Contracts

Occupancy Permit. Provided further that notwithstanding the Commencement Date of the Lease as hereinbefore set out, the Tenant shall not be permitted to enter into possession of the Leased Premises until the Tenant has obtained at its sole expense, an occupancy permit from the proper governmental authority. The Landlord, in its sole discretion, may waive this provision. Provided further, the Tenant agrees to use its best efforts to obtain same prior to occupancy.
