Common use of Objective and Business of the Company Clause in Contracts

Objective and Business of the Company. (a) The objective and business of the Fund is to purchase, sell (including short sales), invest and trade in Securities, on margin or otherwise, and to engage in any financial or derivative transactions relating to Securities or otherwise. The Fund may carry out its activities directly or indirectly through the purchase of interests in Portfolio Hedge Funds. Notwithstanding any provision of this Agreement to the contrary, the Fund, and each Director on behalf of the Fund (or its delegates), may execute, deliver and perform all contracts, agreements, subscription documents and other undertakings and engage in all activities and transactions that may in the opinion of the Board of Directors be necessary or advisable to carry out the Fund’s objective or business.
