Common use of Number of Repurchased Shares Clause in Contracts

Number of Repurchased Shares. Counterparty represents that it could have purchased Shares, in an amount equal to the product of the Number of Options and the Option Entitlement, on the Exchange or otherwise, in compliance with applicable law, its organizational documents and any orders, decrees, contractual agreements binding upon Counterparty, on the Trade Date.

Number of Repurchased Shares. Counterparty represents that it could have purchased Shares, in an amount equal to the product of the Number of Options and the Option Entitlement, on the Exchange or otherwise, in compliance with applicable law, its organizational documents and any orders, decrees, decrees and contractual agreements binding upon Counterparty, on the Trade Date and the Premium Payment Date.

Counterparty represents that it could have purchased Shares, in an amount equal to the product of the Number of Options and the Option Entitlement, on the Exchange or otherwise, in compliance with applicable law, its organizational documents and any orders, decrees, decrees and contractual agreements binding upon Counterparty, on the Trade Date.

Counterparty represents that it could have purchased Shares, in an amount a number of Shares equal to (i) the product of the Number of Options Options, Option Entitlement and the Option Entitlementamount by which the Cap Price exceeds the Strike Price, divided by (ii) the Cap Price, on the Exchange or otherwise, in compliance with applicable law, its organizational documents and any orders, decrees, decrees and contractual agreements binding upon Counterparty, on the Trade Date.

Number of Repurchased Shares. Counterparty represents that it could have purchased Shares, in an amount equal to the product of the Number of Options and the Option Entitlement, on the Exchange or otherwise, in compliance with applicable law, its organizational documents and any orders, decreesdecrees and, to the extent permitted under the terms of the Credit Agreement dated as of May 27, 2005 (the “Credit Agreement”), contractual agreements binding upon Counterparty, on the Trade Date.

Number of Repurchased Shares. Counterparty represents that it could have purchased Shares, in an amount equal to the product of the Number of Options and the Option Entitlement, on the Exchange or otherwise, in compliance with applicable law, its organizational documents and any orders, decrees, decrees and contractual agreements binding upon Counterparty, on the Trade Date, the Premium Payment Date and each Additional Premium Payment Date.
