Common use of Notwithstanding Clause in Contracts

Notwithstanding. 14 teachers who enter the Plan on or after August 1, 1990 may under exceptional circumstances such as serious illness, death, resignation or early retirement withdraw from the Plan at any time during the year(s) of deferral provided the withdrawal is approved by the Board. Such approval shall not be unreasonably withheld. Repayment shall be pursuant to .16.
